    Welcome to Courier Recruit. These Terms and Conditions ("Terms") govern your access to and use of our website and mobile application (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms, along with our Privacy Policy, which is incorporated by reference. Courier Recruit provides a job board and related services for businesses seeking to hire couriers and for drivers looking for courier jobs. These Terms apply to all users of the Platform, including employers, drivers, and visitors.

  2. User Eligibility
    2.1. General Eligibility
    To use the Platform, you must:
    • Be at least 18 years old.
    • Have the legal capacity to enter into a binding contract.
    • Comply with all applicable laws and regulations.
    2.2. Employer Eligibility
    Employers must:
    • Be a legally registered business entity in their jurisdiction.
    • Provide accurate and truthful information about their business during registration.
    • Have the necessary legal capacity to enter into employment contracts with drivers.
    2.3. Driver Eligibility
    Drivers must
    • Hold a valid driving license and any required certifications or permits if operating a motor vehicle.
    • For motorbike couriers, a valid motorbike license is required.
    • Peddle bike couriers are not required to hold a driving license but must comply with all relevant legal requirements related to cycling and courier work.
    • Provide accurate and truthful information during registration.
    • Comply with all relevant legal requirements related to the mode of transport they are using for courier work.
  3. Account Registration
    3.1. Account Creation
    To use certain features of the Platform, you must create an account. When creating an account, you agree to:
    • Provide accurate, complete, and up-to-date information as requested during the registration process.
    • Maintain and promptly update your account information to ensure it remains accurate and complete.
    3.2. Account Responsibilities
    You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to:
    • Notify Courier Recruit immediately if you suspect any unauthorised use of your account.
    • Log out of your account at the end of each session to prevent unauthorised access.
    Courier Recruit is not liable for any loss or damage resulting from your failure to protect your account information.
  4. Job Posting and Application Process
    4.1. For Employers
    Employers can post job openings on the Platform. When posting a job, you agree to:
    • Provide clear, accurate, and lawful job descriptions.
    • Specify any qualifications, certifications, or licenses required for the position.
    • Not engage in any discriminatory practices or post content that violates any laws or regulations.
    You can manage your job postings by pausing, reposting, or closing them as needed. Courier Recruit reserves the right to review and remove any job postings that violate these Terms or applicable laws.
    4.2. For Drivers
    Drivers can browse job postings and apply for positions through the Platform. By applying for a job, you agree to:
    • Provide accurate and truthful information in your application and profile.
    • Maintain up-to-date documents, such as your driving license and certifications.
    • Communicate professionally and honestly with potential employers.
    Your application and profile information, including documents, may be shared with employers during the job application process.
    4.3. Application Matching
    The Platform may provide tools to help match employers with suitable drivers based on criteria such as location, experience, and qualifications. These tools are intended to assist users but do not guarantee job placement or hiring outcomes.
  5. Document Management
    5.1. Driver Document Uploads
    Drivers are required to upload and maintain documents relevant to their work, such as driving licenses, insurance certificates, and background checks. By uploading these documents, you confirm that they are accurate, current, and legally valid.
    5.2. Document Visibility for Employers
    Employers may view and download documents provided by drivers as part of the job application process. However, employers must treat these documents with confidentiality and use them solely for evaluating job candidates.
    5.3. Document Expiry Notifications
    The Platform will notify drivers when key documents are nearing expiration. However, it is the driver’s responsibility to ensure their documents are renewed and updated promptly. Failure to do so may result in restrictions on your ability to apply for jobs or use the Platform.
  6. Payment and Financial Transactions
    6.1. No Financial Intermediary Role
    Courier Recruit acts solely as a facilitator connecting employers with drivers. We do not manage, facilitate, or mediate any financial transactions between employers and drivers. All payment terms, rates, and methods must be agreed upon directly between the employer and the driver.
    6.2. No Liability for Payment Issues
    Courier Recruit is not responsible for any payment disputes, wage discrepancies, or financial issues between employers and drivers. We recommend that both parties clearly agree on payment terms before entering into any work arrangement.
    6.3. Employer Responsibility
    Employers are solely responsible for compensating drivers as agreed upon. Employers must comply with all relevant labor laws, including minimum wage requirements, and are responsible for handling any tax obligations associated with payments to drivers.
    6.4. Driver Responsibility
    Drivers are responsible for ensuring they receive payment as agreed upon and for fulfilling their tax obligations. Courier Recruit recommends that drivers maintain clear communication with employers regarding payment expectations and methods.
  7. Subscription Fees, In-App Purchases, and Payments
    7.1. Subscription Fees
    • The Platform offers various subscription plans, with fees varying based on the plan selected. Subscription fees are billed on a recurring basis (monthly or annually) depending on the plan chosen. By subscribing, you agree to pay the applicable subscription fees as indicated at the time of purchase.
    • All subscription fees are due in full at the beginning of each billing cycle and will be automatically renewed unless you cancel your subscription before the renewal date. You can manage or cancel your subscription at any time through your account settings.
    7.2. In-App Purchases
    • The Platform may offer in-app purchases that provide additional features or content. Inapp purchases are processed through your app store account, including Google Play and the App Store, and are subject to the terms and conditions of the respective app store.
    • All in-app purchases are final and non-refundable, except as required by law or as otherwise stated in these Terms.
    7.3. Payment Processing
    • For web-based users, payments are processed through Stripe or other designated payment processors. By making a payment, you agree to the terms and conditions of the payment processor.
    • Courier Recruit is not responsible for any errors or issues that arise during the payment process, but we will work with you and the payment processor to resolve any problems.
    7.4. Refunds
    • Subscription fees and in-app purchases are generally non-refundable. However, refunds may be granted at our discretion in cases of accidental purchases, technical issues, or as required by law.
    • To request a refund, please contact our support team with the details of your purchase.
    7.5. Changes to Fees
    • Courier Recruit reserves the right to change subscription fees or introduce new fees at any time. We will notify you of any fee changes in advance by posting the updated fees on the Platform or by other means of communication.
    • Your continued use of the Platform after the fee change takes effect constitutes your agreement to the new fees.
  8. Review and Rating System
    8.1. Posting Reviews
    Both employers and drivers can leave reviews based on their experiences. Reviews must be honest, respectful, and free from offensive, defamatory, or misleading content. By posting a review, you agree that:
    • Your review reflects your true experience and is not intended to harm or defame another user.
    • You will not post any content that violates the privacy or rights of another person.
    8.2. Review Moderation
    Courier Recruit reserves the right to review, edit, or remove reviews that violate our policies or are flagged by other users. We may also suspend or terminate accounts that repeatedly violate our review guidelines
    8.3. Handling Disputes Over Reviews
    If you believe a review is false, misleading, or inappropriate, you may contact Courier Recruit for assistance. We will investigate and take appropriate action, which may include removing the review or addressing the issue with the user who posted it.
  9. Content Ownership and Use
    9.1. User Content Ownership
    Users retain ownership of the content they post on the Platform, including job listings, profiles, and reviews. By posting content, you grant Courier Recruit a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute your content in connection with the operation and promotion of the Platform.
    9.2. Courier Recruit Content
    All content provided by Courier Recruit, including text, graphics, logos, software, and other materials, is the intellectual property of Courier Recruit or its licensors. You are granted a limited license to access and use this content for personal or business purposes related to the Platform. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written consent.
  10. Prohibited Activities
    10.1. Prohibited Uses
    You agree not to engage in any of the following activities while using the Platform:
    • Posting false, misleading, or fraudulent information.
    • Engaging in harassment, abuse, or harm towards other users.
    • Using the Platform for any unlawful or unauthorized purpose, including violating any applicable laws or regulations.
    • Attempting to interfere with or disrupt the operation, security, or functionality of the Platform.
    10.2. Consequences of Violations
    Violating these Terms may result in the suspension or termination of your account, the removal of your content from the Platform, and potential legal action. Courier Recruit reserves the right to take appropriate measures to enforce these Terms and protect the integrity of the Platform.
  11. Limitation of Liability
    11.1. General Disclaimer
    Courier Recruit provides the Platform on an "as is" and "as available" basis. We make no warranties or representations, express or implied, about the accuracy, reliability, or availability of the Platform or its content. To the fullest extent permitted by law, Courier Recruit disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
    11.2. Limitation of Liability
    To the maximum extent permitted by law, Courier Recruit, its affiliates, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.
    11.3. Cap on Liability
    In any event, Courier Recruit’s total liability to you for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of £100 or the total amount paid by you to Courier Recruit in the past 12 months.
  12. Indemnification
    You agree to indemnify, defend, and hold harmless Courier Recruit, its affiliates, and its employees from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
    • Your use of the Platform.
    • Your violation of these Terms or any applicable laws.
    • Your violation of any rights of another person or entity.
  13. Termination of Services
    13.1. Termination by Courier Recruit
    Courier Recruit reserves the right to terminate or suspend your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to violations of these Terms or if we believe that your actions may harm or violate the rights of other users or third parties
    13.2. Termination by You
    You may terminate your account at any time by contacting us or following the account closure procedures on the Platform. Upon termination, you must cease all use of the Platform and any content obtained through it.
    13.3. Effect of Termination
    Termination of your account will not affect any rights or obligations that accrued prior to the termination, including your obligations to pay any outstanding fees. The provisions of these Terms that by their nature should survive termination shall remain in effect.
  14. Dispute Resolution
    14.1. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland, including the laws of England, Scotland, Wales, and Northern Ireland, without regard to any principles of conflicts of law that would require the application of the laws of any other jurisdiction.
    14.2. Arbitration
    Any disputes arising out of or related to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, England, and shall be conducted in English. The arbitrator’s decision shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.
    14.3. Waiver of Class Actions
    You agree to resolve disputes with Courier Recruit on an individual basis and waive your right to participate in a class action or other collective legal proceedings against us.
    14.4. Equitable Relief
    Nothing in these Terms shall prevent Courier Recruit from seeking equitable relief, including injunctions, in a court of competent jurisdiction to prevent the infringement or misuse of its intellectual property rights.
  15. Modifications to Terms
    Courier Recruit reserves the right to modify these Terms at any time. We will notify you of any material changes to these Terms by posting the revised Terms on the Platform and updating the “Last Updated” date. Your continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms.

  17. Miscellaneous
    17.1. Entire Agreement
    These Terms, along with the Privacy Policy, constitute the entire agreement between you and Courier Recruit regarding the use of the Platform and supersede any prior agreements or understandings, whether written or oral.
    17.2. Severability
    If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
    17.3. No Waiver
    The failure of Courier Recruit to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
    17.4. Assignment
    You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Courier Recruit may assign its rights and obligations under these Terms without restriction.
    17.5. Headings
    The headings in these Terms are for convenience only and shall not affect the interpretation of these Terms.
